GENERAL TERMS AND CONDITIONS – GROUP MEMBERSHIP

BARRY GROENTEMAN BOXING SCHOOL

Article 1 – Applicability

1. These terms and conditions apply to all group memberships, training sessions, memberships, activities and services offered by Boksschool Barry Groenteman.
2. By registering, the member confirms that they have read and accepted these terms and conditions.
3. Wherever the term “member” is used in these terms and conditions, it shall also include the parent or legal guardian of a minor member.

Article 2 – Membership

1. A group membership entitles the member to participate in the regular group training sessions appropriate to their age, experience and skill level.
2. The boxing school reserves the right to place members in a different class or group if deemed necessary by the trainers.
3. Participation in special events, clinics, examinations, competitions or other activities may be subject to additional conditions.

Article 3 – Contract Duration

1. Membership is entered into for a fixed period of twelve (12) months.
2. During this initial contract period, the membership cannot be terminated early, except where required by law or with the written consent of Boksschool Barry Groenteman.
3. After the initial contract period, the membership will automatically continue for an indefinite period.
4. After the initial contract period, a notice period of one calendar month applies.
5. Cancellation must be submitted in writing by email.
6. Cancellations will only be processed after written confirmation by the administration.

Article 4 – Rejoining

1. A former member who registers again shall be considered a new member.
2. Any re-registration will be subject to the membership types, rates and conditions applicable at that time.
3. No rights can be derived from previous rates, promotions, discounts or conditions after termination of the membership.

Article 5 – Payment

1. Payment shall be made exclusively through automatic direct debit.
2. Membership fees will generally be collected around the 26th day of each month for the following membership period.
3. Members are responsible for ensuring sufficient funds are available in their bank account.
4. Failure of a direct debit does not release the member from their payment obligations.
5. Any changes in membership fees will be communicated in a timely manner.

Article 6 – Payment Arrears and Chargebacks

1. In the event of a failed payment, the member will receive a payment request.
2. Participation in training sessions may be temporarily suspended until payment has been received.
3. In the event of repeated chargebacks or payment arrears, Boksschool Barry Groenteman reserves the right to impose additional payment conditions.
4. In cases of structural payment issues, advance payment may be required before participation in training sessions is permitted.
5. Outstanding amounts may be increased with administration fees, statutory interest and collection costs in accordance with applicable law.

Article 7 – Holidays and Absence

1. Holidays, travel, examinations, studies, work, family circumstances, relocation, participation in other sports or personal circumstances do not entitle the member to refunds, suspension, extensions or reductions of membership fees.
2. Memberships cannot be temporarily paused.
3. Membership fees remain payable during holidays, public holidays and adjusted schedules.
4. The boxing school may operate an adjusted schedule during school holidays and public holidays.

Article 8 – Medical Circumstances

1. In the event of long-term illness, serious injury or a medical condition that makes participation impossible for an extended period, a written request for temporary suspension may be submitted.
2. Such requests will only be considered upon submission of a written statement from a physician, medical specialist or other qualified healthcare professional.
3. Each request will be assessed individually by Boksschool Barry Groenteman.
4. Any approved suspension or exception will only be valid if confirmed in writing.
5. Short-term injuries, minor complaints or preventive rest periods do not automatically entitle a member to suspension of the membership.

Article 9 – Schedule and Trainers

1. Boksschool Barry Groenteman reserves the right to modify class schedules, trainers, training locations, group divisions and training timetables.
2. Such changes do not entitle members to refunds, termination of the agreement or compensation.
3. The absence of a specific trainer does not entitle members to refunds, provided that the training session can reasonably continue.

Article 10 – Participation and Own Risk

1. Participation in training sessions, sparring sessions, competitions, events and other activities is entirely at the member’s own risk.
2. Members are responsible for their own physical and mental health.
3. Any medical limitations or conditions must be reported to the boxing school in advance.

Article 11 – Liability

1. Boksschool Barry Groenteman shall not be liable for loss, theft or damage to personal property.
2. Boksschool Barry Groenteman shall not be liable for injuries, damages or consequential damages arising from participation in training sessions or activities, except in cases of intentional misconduct or gross negligence.
3. Use of the boxing school’s facilities is entirely at the member’s own risk.

Article 12 – Conduct and Safety

1. Members must behave respectfully towards trainers, employees, volunteers and fellow members.
2. Discrimination, aggression, threats, intimidation, bullying, violence or any other inappropriate behaviour will not be tolerated.
3. Instructions from trainers and staff must be followed immediately.
4. The boxing school reserves the right to refuse participation if the safety of the member or others may be compromised.

Article 13 – Suspension and Termination

1. In cases of serious or repeated misconduct, a member may be temporarily suspended or permanently removed.
2. In such cases, no refund of membership fees already paid will be granted.
3. Suspension or termination does not affect any outstanding payment obligations.

Article 14 – Photography and Video Material

1. Photographs and videos may be taken during training sessions, events, examinations, competitions and other activities.
2. Such material may be used for the website, social media channels, newsletters, promotional materials and other communication purposes of Boksschool Barry Groenteman.
3. Members or parents/legal guardians may object in writing to the publication of photographs or videos.

Article 15 – Force Majeure

1. In the event of force majeure, emergencies, renovations, technical failures, government measures or other circumstances beyond the reasonable control of Boksschool Barry Groenteman, training services may be temporarily adjusted.
2. Such circumstances do not automatically entitle members to refunds or compensation.

Article 16 – House Rules

1. Members are required to comply with the applicable house rules of Boksschool Barry Groenteman.
2. The house rules form an integral part of these terms and conditions.

Article 17 – Exceptional Circumstances

1. In exceptional situations, Boksschool Barry Groenteman may deviate from these terms and conditions at its own discretion.
2. Any exception granted in an individual case shall not create rights or expectations for other members or future situations.

Article 18 – Governing Law

1. All agreements between the member and Boksschool Barry Groenteman shall be governed exclusively by Dutch law.
2. Any disputes shall be submitted to the competent court in the Netherlands.
